Following the Supreme Court’s decisive 6-3 ruling on June 29, 2023, affirmative action in college admissions, which formerly considered race as a factor, is now prohibited. While this does not have a direct impact on the legality of internal workplace DEI efforts, there are questions on how to move forward within a volatile and uncertain landscape with the potential of legal action against DEI continuing to gain speed. NYU legal expert and Seramount speaker, Kenji Yoshino with his colleague David Glasgow have put forth a framework that companies can use to continue moving the needle while in this new legal landscape.
